Purposes of the processing for which the personal data are intended and related legal basis Your personal data will be processed: (i) without your consent (Section 6, letters b, c, f, GDPR), for the following purposes: a) performance of pre-contractual and contractual obligations deriving from the execution of a possible contract or purposes of tax exemption (e.g. when you make a purchase at any of our retail outlets we will collect necessary information about you to ensure we can fulfill your order or chosen service); b) compliance with legal obligations, as provided for by a regulation or a law (national or EU), or perform an order of public or judicial Authority or controlling Authority to which the Joint Controllers are subject; c) exercise the rights of the Joint Controllers, with particular reference to judicial defensive rights. Processed Categories of Personal Data Pursuant to Section 4, n. 1, GDPR, for “personal data” and within the purposes of processes mentioned under par. 2) above, we shall exclusively process those personal data concerning, by way of example, your name and family name, tax code, date of birth, VAT number, country of residence, domicile, number of passport and/or ID, work address, email, certified email address, phone and fax numbers, employer company, business role and/or position. Pursuant to principle of “data minimization” (Section 5, GDPR) you will not send your personal data to Joint Controllers, except where personal data are strictly necessary to perform contractual and / or commercial activities. In case you send to Joint Controllers any personal data that is not strictly necessary to perform contractual and/or commercial activities, they should be transferred to Joint Controllers anonymously or under pseudonyms, as expressly stated by GDPR. Should it be necessary to process more data in addition to the ones of legal representative and/or contact persons, for the purpose of executing contractual relationship with a customer (legal entity, hereinafter, the “Client”), and if these personal data could not be obtained in anonymous form or under pseudonyms, the Client declares and guarantees that the processing of personal data will be in compliance with GDPR for all data that will be communicated to Joint Controllers during the performance of the contract. In particular, the Client declares that it has been provided to any Data Subject an adequate information notice in which it is expressly mentioned the possibility to provide personal data to third entities and to have obtained the necessary consents for the purpose. Customer undertakes to indicate to its employees and/or collaborators that the present Information Notice is also available on the website www.viviennewestwood.com, so that the Information Notice can be provided by the Joint Controllers to the data subject, pursuant to Sections 13 and 14, GDPR. 4. Categories of Personal Data Recipients The personal data you will submit to us for the purposes mentioned under Par. 2, above, could be transferred to: (i) employees and collaborators of the Joint Controllers or other entities belonging to the same companies’ group to which the Joint Controllers are party thereof, in their capacity of data processors; (ii) any other entities belonging to the same companies’ group to which the Joint Controllers are part thereof; (iii) any third party (by way of example and not in an exhaustive way, provider for management and maintenance of website, providers, credit institutions, marketing agencies, insurance companies, press agencies), performing outsourced activities on behalf of the Joint Controllers, in their capacity of data processors; (iv) any judicial or controlling Authority, public entities (whether national or foreign ones); The updated list of Processors and persons who are authorized to process personal data is available by Joint Controllers’ seats. 5. Storage and Transfer of Personal Data to Third Countries Your data will be transferred outside of the European Union only in accordance with all the safeguards set forth by EU privacy law. In particular, personal data may be transferred to service providers located outside of the EU, with whom it has been contractually agreed, by means of the adoption of standard contractual clauses duly executed, that such data shall be granted the adequate level of protection required by EU law. The data shall not be disseminated. 6. Personal Data Storage Period Personal Data provided for the purposes indicated under Par. 2, section (i) above is processed and stored for the entire duration of the executed contract; as of the termination of such contractual relationship, for whichever reason or cause, personal data will be stored as long as time-barring legal terms will be elapsed. Personal Data provided for the purposes indicated under Par. (2), section (ii) above is processed and stored for the time necessary for the performance of the same purposes although this period shall not exceed 2 years from the date on which the Joint Controllers receive the consent of the data subject. 7. In the event that, during the performance of the contractual relationship, the supplier (legal entity, hereinafter, the “Supplier”), communicate to Joint Controllers (not anonymously or not under pseudonyms) more data in addition to the ones of legal representative and/or contact persons, the same Supplier declares and guarantees to process all above personal data lawfully and in compliance with GDPR, furthermore, the Supplier declares that it has been provided to any Data Subject an adequate information notice, in which it is expressly mentioned the possibility to provide personal data to third entities and to have obtained the necessary consents for the purpose. 4. Categories of Personal Data Recipients For the purposes mentioned under par. 2 above, the personal data you will submit could be transferred to: 1) employees and collaborators of the Joint Controllers, in their capacity of person authorized to process personal data; 2) other entities belonging to the same companies’ group to which the Joint Controllers are part thereof; 3) any third party (such as provider for management and maintenance of website and/or management information systems, providers, credit institutions, professional companies, etc.), performing outsourced activities on behalf of the Joint Controllers, in their capacity of data processors; 4) controlling Authority, public entities and institutions (whether national or foreign ones). 5. Storage and Transfer of Personal Data to Third Countries The Joint Controllers declare that the process and the storage of the personal data take place on servers located within and outside EU, belonging to and/or in the possession of the Joint Controllers and/or third party companies, as duly appointed as processors. Where necessary, the transfer to non EU-countries will be performed, anyhow, in compliance with the provisions under par. V, GDPR (Section 46), adopting standard contractual clauses drafted pursuant to versions no. 2004/915/EC e n. 2010/87/EU, as adopted by the European Commission. Qualora, ai fini dell’esecuzione del rapporto contrattuale con un cliente (persona giuridica, di seguito, il “Cliente”), si rendesse indispensabile trattare dati personali ulteriori rispetto a quelli dei legali rappresentanti e/o delle persone di contatto del medesimo, e gli stessi non potessero essere acquisiti in forma anonima o pseudonimizzata, il Cliente dichiara e garantisce di trattare legittimamente ed in conformità al GDPR tutti i dati personali che comunicherà ai Contitolari, nel corso dello svolgimento del contratto, e, in particolare, dichiara di aver fornito agli Interessati adeguata informativa nella quale viene espressamente menzionata la possibilità di fornire i dati personali a società terze e di avere ottenuto gli eventuali consensi necessari allo scopo. Il Cliente si impegna, altresì, ad indicare ai propri dipendenti e/o collaboratori che la presente Informativa è altresì consultabile sul sito www.viviennewestwood.com, in modo tale che la stessa possa essere fornita dai Contitolari ai soggetti Interessati ai sensi degli articoli 13 e 14 del GDPR. 4. Il conferimento dei dati per le finalità sopra menzionate è obbligatorio. La mancanza dei dati e/o l’eventuale espresso rifiuto al trattamento comporterà l'impossibilità per i Contitolari di svolgere le proprie obbligazioni contrattuali oppure la possibile violazione di richieste delle Autorità competenti. 3. Categorie di dati personali trattati Ai sensi dell’art. 4, n. 1, GDPR i "dati personali" che saranno trattati dai Contitolari, nell’ambito delle finalità dei trattamenti sopra indicati, hanno ad oggetto, a titolo di esempio, nome e cognome, codice fiscale, fotocopia documento di identità, numero di partita IVA, residenza, domicilio, sede del luogo di lavoro, indirizzo mail o PEC, numero di telefono e fax, ed eventualmente, dati bancari, finanziari ed assicurativi, etc. Lei si asterrà dall’inviare ai Contitolari dati personali, che non siano strettamente necessari per lo svolgimento delle attività contrattuali e/o commerciali. In caso contrario, i dati personali dovranno essere trasmessi ai Contitolari in forma anonima o pseudonimizzata, in conformità al principio di minimizzazione previsto dall’articolo 5, comma 1, GDPR. Nell’ipotesi che, nello svolgimento del rapporto contrattuale, il fornitore (persona giuridica, di seguito, il “Fornitore”) comunichi ai Contitolari (in modo non anonimo o non pseudonimizzato) dati personali ulteriori rispetto a quelli dei legali rappresentanti e/o delle persone di contatto del medesimo, il Fornitore dichiara e garantisce di trattare legittimamente ed in conformità al GDPR tutti i suddetti dati personali, dichiarando altresì di aver già provveduto a fornire agli Interessati adeguata informativa, nella quale sia espressa la possibilità di fornire i dati personali a società terze e di avere ottenuto gli eventuali consensi necessari allo scopo. 4. Categorie di destinatari dei dati personali Per le finalità di cui al paragrafo 2 che precede i dati personali da Lei forniti potranno essere resi accessibili: 1) a dipendenti e collaboratori dei Contitolari, nella loro qualità di addetti autorizzati al trattamento dei dati; 2) ad altre entità giuridiche del Gruppo societario di cui i Contitolari fanno parte; 3) a terzi soggetti (ad esempio, provider per la gestione e manutenzione del sito web e/o dei gestionali informatici, fornitori, istituti di credito, studi professionali, ecc.) che svolgono attività in outsourcing per conto dei Contitolari, nella loro qualità di responsabili del trattamento; 4) ad Autorità di vigilanza, enti ed organismi pubblici (nazionali ed esteri). 5. Conservazione e trasferimento di dati personali all’estero I Contitolari dichiarano che la gestione e la conservazione dei dati personali avviene su server ubicati all’interno ed all’esterno dell’Unione Europea di proprietà e/o nella disponibilità dei Contitolari e/o di società terze incaricate e debitamente nominate quali Responsabili del trattamento. Ove si rendesse necessario, il trasferimento all’estero dei dati nei paesi extra-UE avverrà, in ogni caso, in conformità alle disposizioni contenute nel Capo V, GDPR (articolo 46), mediante l’adozione di clausole-tipo redatte sulla base delle versioni n. 2004/915/EC e n. 2010/87/EU elaborate dalla Commissione Europea. Periodo di conservazione dei dati personali I dati personali raccolti per le finalità indicate al paragrafo 2 che precede saranno trattati e conservati per tutta la durata del rapporto contrattuale instaurato. Catégorie des données personnelles traitées Aux termes de l’article 4, n. 1 du RGPD, les "données personnelles" traitées par les Cotitulaires dans le cadre des finalités des traitements indiqués ci-dessus, ont pour objet, à titre d’exemple, le nom et le prénom, le code fiscal, la photocopie d’une pièce d’identité, le numéro de TVA, l’adresse de résidence, l’adresse de domicile, l’adresse mail ou de poste électronique certifiée, le numéro de téléphone et de fax, et éventuellement, les coordonnées bancaires, ainsi que les données financières et d’assurance, etc. Vous vous abstiendrez d’envoyer aux Cotitulaires des données personnelles non strictement nécessaires à l‘exercice des activités contractuelles et/ou commerciales. Si tel n’est pas le cas, les données personnelles devront être transmises aux Cotitulaires de manière anonyme ou pseudonymisée, conformément au principe de minimisation des données personnelles collectées visé à l’article 5, alinéa 1, du RGPD. Si, dans le cadre de la relation contractuelle, le fournisseur (personne morale, dénommée ci-après, le “fournisseur”) communique aux Cotitulaires (de manière non anonyme ou non pseudonymisée) d’autres données personnelles en plus de celles de ses représentants légaux et/ou de ses personnes de contact, il s’engage à faire en sorte de traiter légitimement et conformément au RGPD toutes lesdites données personnelles et déclare avoir fait le nécessaire afin de délivrer aux personnes concernées une note d’information en bonne et due forme, dans laquelle est indiquée la possibilité de fournir les données personnelles à des sociétés tierces et d’avoir obtenu les éventuelles autorisations nécessaires pour ce faire. 4.
